Accordingly, this case is DISMISSED WITH PREJUDICE as a sanction for Plaintiffs failure to comply with this Courts Orders and for his failure to comply with his obligations under the Federal Rules of Civil Procedure. The Clerk of the Court is directed to enter judgment in Defendants favor and against Plaintiff pursuant to Federal Rule of Civil Procedure 58. All pending motions are denied as moot, and all dates on deadlines on the Courts calendar are vacated. Plaintiff must still pay the full docketing fee of $350.00 even though his case has been dismissed. In addition, Plaintiff must still pay to Defendants the $349.27 in costs imposed by the Court in its February 28, 2018 Order. If Plaintiff wishes to appeal this dismissal, he must file a notice of appeal with this Court within thirty (30) days of the entry of judgment. Fed. R. App. P. 4(a). A motion for leave to appeal in forma pauperis should set forth the issues that Plaintiff plans to present on appeal. See Fed. R. App. P. 24(a)(1)(C). If Plaintiff chooses to appeal, he will be liable for the $505.00 appellate filing fee regardless of the outcome of the appeal. Finally, Plaintiff is ORDERED to inform the court in any new case(s) that he files in which he seeks to proceed in forma pauperis: (1) of this Order; (2) of his requirement to pay costs imposed in this case; (3) and of his failure to pay those costs (assuming that he has not paid them) so that the judge presiding over his newly filed case(s) may determine for himself or for herself whether Plaintiff should be allowed to proceed in forma pauperis. If Plaintiff fails to inform the court, either in his in forma pauperis application or in his litigation history section of his complaint, that court may deem his failure to constitute a fraud upon the Court, and this Court, upon being informed of his failure, will consider sanctioning him by imposing a prohibition upon him that precludes him from proceeding in forma pauperis in any case(s) that he files with this Court until he satisfies the costs imposed upon him.(ED, ilcd) (Entered: 04/20/2018)" @default.
