- ilcd;;1:16-cv-01064_de80 RegisterActionDescriptionText "TEXT ORDER entered by Chief Judge James E. Shadid on 2/14/2017. Plaintiff has filed a motion to continue 61 and a motion to amend his complaint. 59 Plaintiff's current complaint alleges Defendants at FCI Pekin retaliated against him, engaged in a conspiracy and were deliberately indifferent to his medical condition. See June 30 2016 Merit Review. Plaintiff has been transferred twice since the filing of his complaint and now seeks to add claims against Defendants at the second facility in Ashland, Kentucky alleging continued retaliation. 59 First, the Court does not accept piecemeal amendments. A Plaintiff wishing to amend his complaint must attach a complete, proposed complaint to his motion including all claims against all Defendants. Second, as the Court has previously advised Plaintiff, he may not combine unrelated claims against different Defendants in one lawsuit. See January 9, 2017 Case Management Order. His motion to amend is therefore denied. 59 As for his motion for additional time, Plaintiff does not ask for a specific extension. Instead, Plaintiff says he will be transferred and therefore he will be without his legal materials. 61 The Court recently directed Defense counsel to respond to Plaintiffs claim concerning his legal materials. See February 13, 2017 Text Order. In addition, discovery in this case does not end until June 9, 2017. See January 25, 2017 Scheduling Order. Therefore, the motion is denied. 61 (JS, ilcd) (Entered: 02/14/2017)" @default.
