Dr. Tilden avers that he saw Plaintiff on March 24, 2016, a week after Plaintiff filed his motion. Dr. Tilden avers that the scar where Plaintiff's sebaceous cyst was removed is two millimeters and well-healed, and that Plaintiff's penis is "completely normal... with no cysts, or tenderness." (Dr. Tilden Aff. para. 9.) Dr. Tilden did note enlarged sebaceous glands but avers that this "is not uncommon or abnormal." No plausible inference arises from this record that Plaintiff is at a risk of irreparable injury or that his claim has some likelihood of success on the merits. Girl Scouts of Manitou Council, Inc. v. Girl Scouts of U.S. of America, 549 F.3d 1079, 1085 (7th Cir. 2008)(setting forth requirements for a preliminary injunction). Further, Plaintiff's claim appears to already have been addressed and dismissed on merit review by Judge McDade, 15-CV-1405, and Plaintiff has three strikes under 28 U.S.C. § 1915(g), neither of which Plaintiff informed this Court when he filed this case. By July 8, 2016, Plaintiff is directed to file a supplemental response to the motion to dismiss showing good cause why this case should not be dismissed as frivolous and malicious and another strike assessed.
