- ilcd;;1:16-cv-01089_de29 RegisterActionDescriptionText "TEXT ORDER entered by Judge Joe Billy McDade on 1/25/2017. Plaintiff filed a Motion for Status 19 which is GRANTED as Plaintiff is advised that, as some of the Defendants have appeared and filed answers, a scheduling order will issue. Plaintiff files a motion for recruitment of counsel claiming that it will be difficult for him to undertake discovery in this case. The Court does not possess the authority to require an attorney to accept pro bono appointments on civil cases such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). The most that the Court can do is to ask for volunteer counsel. Jackson v. County of McLean, 953 F.2d 1070, 1071 (7th Cir. 1992)(holding that it is a fundamental premise that indigent civil litigants have no constitutional or statutory right to be represented by counsel in federal court.). In determining whether the Court should attempt to find an attorney to voluntarily take a case, the question is whether the plaintiff appears competent to litigate his own claims, given their degree of difficulty, and this includes the tasks that normally attend litigation: evidence gathering, preparing and responding to motions and other court filings, and trial. Pruitt, 503 F.3d at 655 (emphasis in original). Here, Plaintiff appears to be literate; he has filed cogent pleadings with the Court; and his claim has survived a merit review. Furthermore, Plaintiff's claim of failure to protect is not unduly complex and relies on information in his own personal knowledge. 20 is DENIED. Plaintiff files 21 a motion for default. It appears that defendants who have been served have filed timely filed their answers. The Court notes that Defendant FF3981C has not returned a signed waiver. The Office of the Attorney General is requested, within 14 days, to disclose whether it will be representing Defendant FF3981C. If not, the Attorney General is asked to determine by whom this Defendant is employed. 21 is DENIED.(JS, ilcd) (Entered: 01/25/2017)" @default.
