- ilcd;;1:16-cv-01089_de60 RegisterActionDescriptionText "TEXT ORDER entered by Judge Joe Billy McDade on 6/9/2017: Plaintiff filed a complaint alleging that on or about March 13, 2015, his cellmate, Hoskins, began acting out and threatening him. Plaintiff requested that he be moved to a different cell, but this was denied. On March 20, 2015, he was allegedly attacked by Hoskins. Plaintiff files 39 a motion to compel Defendants' responses to several of his requests for production. In request to produce # 1, Plaintiff asked for the staff duty rosters of March 16, 2015, claiming to have learned through disclosures that Hoskins made threats on this day as well. Defendants originally objected on relevancy grounds ( 39 - p. 7) but have filed a response indicating that the March 16, 2015 rosters have been provided. Plaintiff's motion as to request #1 is, therefore, MOOT. Plaintiff's request to produce #2 sought the production of photographs relevant to an incident of March 20, 2015. Defendants responded by referring Plaintiff to the incident reports. The Court, of course, does not have a copy of the incident reports and it is unclear whether photographs were provided. Defendants are asked to clarify, within 14 days, whether there are photographs relative to a March 20, 2015 incident, and whether they have been provided. Defendants also objected to request #3, the production of all documents relating to an incident which allegedly occurred between Plaintiff and Hoskins on March 16, 2015. In their objection they cited relevancy as well as safety and security concerns. Confusingly, Defendants subsequently filed the response asserting that no such documents exist. ( 42 - 4). Defendants are directed, within 14 days, to clarify whether they have any documents responsive to request to produce #3. If they have such information they are to provide it to Plaintiff within 21 days. If the disclosure would trigger security concerns, it may be filed under seal, for the Court's in camera inspection. Plaintiff's motion to compel 39 is GRANTED to the extent that Defendants are to file a response as to requests to produce # 2 and 3. It is rendered MOOT as to request to produce #1.
