He claimed that he has not received his psychotropic medications in weeks and, that when this has happened in the past, he has harmed himself. The Court believed there was a credible threat of harm and requested that the Chief Administrative Officer facilitate the filing of a response. The response, timely filed, contained the affidavit of Healthcare Administrator, Mary Grennan. Ms. Grennan attests that Plaintiff has been on the psychotropic medication, Prozac since September 9, 2015. The prescription expired on March 20, 2016 and was renewed on April 6, 2016. The purpose of a temporary restraining order and ultimately a preliminary injunction is to preserve the status quo pending a final hearing on the merits of the case. American Hospital Assn v. Harris, 625 F.2d 1328, 1330 (7th Cir. 1980). To prevail, "the moving party must demonstrate: (1) a likelihood of success on the merits; (2) a lack of an adequate remedy at law; and (3) an irreparable harm will result if the injunction is not granted." Foodcomm Int'l v. Barry, 328 F.3d 300, 303 (7th Cir. 2003) (citations omitted). Here, Plaintiff cannot successfully allege irreparable harm as he is, once again, receiving his medication. The Emergency Preliminary Injunction 1 is DENIED. Plaintiff's Motion for Service of Process at government expense 8 , is DENIED. When the Amended Complaint undergoes merit review, waivers of service will be issued to the defendants. Plaintiff files a second Emergency Preliminary Injunction 10 in which he alleges that he was taken off of his medication in September 2015. As noted, above, Healthcare Administrator Grennan has submitted an affidavit that Plaintiff has consistently received his psychotropic medication since September 2015, with the exception of the 16 day period between March 20th and April 6th, 2016. 10 is DENIED as MOOT.
