- ilcd;;1:16-cv-01127_de22 RegisterActionDescriptionText "TEXT ORDER Entered by Chief Judge James E. Shadid on 8/16/17: : Plaintiff filed three motions 17 19 21 stating that prison officials at his current place of incarceration have made multiple deductions from his trust fund account for court filing fees. Plaintiff argues that monetary gifts he receives from friends and family are exempt from collection. 28 U.S.C. Sec. 1915(b)(2) provides that Plaintiff must pay 20 percent (20%) of the preceding month's income credited to his account. Income includes money received from all sources. Furthermore, Plaintiff has been granted leave to proceed in forma pauperis in at least three (3) cases in district court, including this case. See 9AD4F0A v. Peterson, No. 08-681 (S.D. Ill. 2008); 9AD4F0A v. Luster, No. 03-3181 (C.D. Ill. 2003). Plaintiff has also been ordered to pay filing fees pursuant to Section 1915(b) in his appellate cases. See 9AD4F0A v. Peterson, No. 09-2361 (7th Cir. 2009); 9AD4F0A v. Jordan-Luster, No. 06-4349 (7th Cir. 2007). Plaintiff must pay 20% of his income for each case in which he has not yet paid the filing fee in full. See Bruce v. Samuels, 136 S. Ct. 627 (2016). Thus, if Plaintiff has filed 2 lawsuits, he must pay 40%, if he has filed three, he must pay 60%, etc. As clarified, Plaintiff's Motions 17 19 21 as they may request a reduction in the deductions from his trust account are DENIED.
