Defendants did not do so, and the proposed renewed summary judgment motion attached to docket entry 80 does not address any of the questions raised by Judge Shadid. Therefore, the claims for the trial include the due process, retaliation, and inhumane conditions claims. Plaintiff's motion for the Court to attempt to recruit pro bono counsel to represent him is denied (d/e 81 ). The Court cannot order an attorney to accept pro bono appointment on a civil case such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). Plaintiff has made reasonable efforts to find counsel, so the question is "whether the difficulty of the casefactually and legallyexceeds the particular plaintiff's capacity as a layperson to coherently present it to the judge or jury himself." Pruitt, 503 F.3d at 655 (7th Cir. 2007). On this record, Plaintiff appears competent to proceed pro se. He has obtained his G.E.D., and his pleadings are coherent and fairly well written. He also has personal knowledge of many of the relevant facts underlying his claims and has been able to successfully oppose two summary judgment motions. On this record, Plaintiff appears able to represent himself for the final pretrial conference and trial. The clerk is directed to issue a telephone writ to secure Plaintiff's presence at the final pretrial conference.
