Plaintiff files 83 and 85 , successive motions for recruitment of pro bono counsel. Plaintiff asserts that he has a learning disability, has never conducted a trial, and has a serious mental illness which affects his motor skills like reading. Plaintiff provides a forensic psychiatric exam conducted on 7/17/18. It reveals that Plaintiff has been diagnosed with a depressive disorder, unspecified anxiety disorder, post-traumatic stress disorder, possible psychotic disorder, and a history of head trauma. The report finds that Plaintiff is marginally fit to stand trial. The Court notes that, thus far in this case, Plaintiff has filed motions for extension, a successful motion to compel, a motion for sanctions and has meaningfully engaged in discovery. In addition, he had filed a 26-page response in opposition to Defendants motion for partial summary judgment. Plaintiff claims that he has had the help of another inmate who has since been paroled. The Court cannot determine on this record, the amount of help Plaintiff has received and cannot find that he is incompetent to litigate this case on his own. This, particularly, as Plaintiff proceeds on claims that in 2014, he lacked hot water in cells #212 and #522; that the toilet in #212 was inoperable for five days with a back-up of sewage and that #212 was infested with mice. These alleged conditions of confinement claims are based upon facts within Plaintiffs own personal knowledge and are not unduly complex. 83 and 85 are DENIED. Plaintiff files 86 , requesting a phone conference with his proposed inmate witnesses Jabor Wilson who is at Menard and Greg Castellans who is at Pontiac. Plaintiff does not assert, however, that he has followed administrative procedures by submitting these requests at the facility where he is being held. See Giampalo v Shaw, 2008 WL 724108, at *6 (C.D. Ill. Mar. 17, 2008) (plaintiff requesting communication with inmates at other correctional centers to make request to the Warden through his counselor). Jan. 23, 2013) (plaintiff may obtain affidavits from inmates in different prisons with permission from the wardens of both facilities.) 86 is DENIED with leave to reassert.
