- ilcd;;1:16-cv-01258_de47 RegisterActionDescriptionText "Text Order: Attempts to settle this case were unsuccessful. Accordingly, the discovery stay is lifted. Discovery closes December 31, 2018. Dispositive motions are due January 31, 2019. If Plaintiff refuses to answer questions at the deposition, then this case will be dismissed, without prejudice. The Court indicated in its last order that it would try to find pro bono counsel for Plaintiff based on Plaintiff's claims that she is mentally ill and illiterate. However, records produced by defense counsel show that Plaintiff was reading at a 6.6 grade level in 2011, up from a 2.3 grade level in 2006. (d/e 38-2, p. 1.) Plaintiff does not appear to be illiterate on this record. Plaintiff is described in the more recent mental health records as cooperative, oriented to time, place, and person, stable, and with a clear and coherent thought process. (Mental Health Progress Notes dated 1/21/2016, d/e 18-11, pp.7-10; 6/30/16, d/e 18-10 p. 4.) The claims in this case are relatively simple from a factual standpointviolation of privacy rights and deliberate indifference by broadcasting Plaintiff's condition and treatment. Plaintiff already has personal knowledge of what happened. At this point, Plaintiff appears competent to proceed pro se. Plaintiff may renew her motion for counsel after Defendants file their summary judgment motion. Entered by Judge Sue E. Myerscough on 08/20/2018. (SKN, ilcd) (Entered: 08/20/2018)" @default.
