- ilcd;;1:16-cv-01267_de91 RegisterActionDescriptionText "TEXT ORDER Entered by Judge Sara Darrow on 7/12/2017. Plaintiff's motion for extension of time 78 is GRANTED, in part, and DENIED, in part. To the extent that Plaintiff seeks an extension of time to file objections to the Court's Summary Judgment Order pursuant to 28 U.S.C. section 636, his motion is denied. A United States District Judge, not a United States Magistrate Judge, entered the Summary Judgment Order against Plaintiff, and therefore, 28 U.S.C. section 636 is inapposite. To the extent that Plaintiff seeks an extension of time to file an appeal, his motion is granted. Federal Rule of Appellate Procedure 4(a)(4) authorizes a district court to extend the time within which a litigant has to file a notice of appeal for up to thirty (30) days upon a finding of excusable neglect or good cause. The Court finds that Plaintiff's circumstancesas set forth in his motionconstitute good cause for his request. Therefore, his motion for an extension of time is granted. Appellate Rule 4(a)(4) limits the extension that this Court may grant to thirty (30) days, and so, the date by which Plaintiff must file his notice of appeal is August 25, 2017. Finally, the Clerk of the Court is directed to send a copy of the Court's Summary Judgment Order to Plaintiff. (KB, ilcd) (Entered: 07/12/2017)" @default.
