- ilcd;;1:16-cv-01272_de192 RegisterActionDescriptionText "TEXT ORDER entered by Judge Colin Stirling Bruce on 2/3/2020. This case was previously set for jury trial on October 29, 2019. On 7/16/19, the Court ordered that the parties to submit an agreed, proposed final pretrial order. For undisclosed reasons, Defendants submitted Defendants' Proposed Final Pretrial Order, apparently with no input from Plaintiff 128 . Defendants also filed a Motion in Limine 124 which has not yet been reviewed. The Court subsequently vacated the trial date as Plaintiff was incarcerated in Texas with various matters pending in Texas state court. As these appear resolved, the Court hereby reschedules this case for jury trial on Tuesday June 9, 2020, at 9:00 a.m. before Judge Colin Bruce in Courtroom A of the Federal Courthouse in Urbana. The Final Pretrial Conference is scheduled for Monday, May 18, 2020, at 1:30 p.m. in Courtroom A. Plaintiff, no longer in custody, is to appear in person unless he contacts the Clerk to make arrangements for an appearance by video. Plaintiff is placed on notice that he must keep the Clerk advised of his current contact information at all times and that the failure to do so could result in dismissal of his case. Defense counsel is to appear for the final pretrial conference in person unless counsel notifies the Clerk of a wish to appear by video. Defendants' aged Motion in Limine 124 , is DENIED with leave to reassert or modify as needed. Pretrial motions are due by April 27, 2020, and responses due by May 12, 2020. The parties are directed to submit an agreed, proposed final pretrial order by May 13, 2020. The Court will provide its preliminary jury instructions to the parties at the final pretrial conference. If the parties which to file proposed jury instructions for the Court's consideration, they are to file them with the proposed final pretrial order. The Court does not favor non-pattern instructions. If any are offered, the proponent is to submit a brief statement as to why the non-pattern instruction is necessary. The parties are to appear in person for jury trial.
