- ilcd;;1:16-cv-01335_de33 RegisterActionDescriptionText "TEXT ORDER entered by Judge Sara Darrow on 1/31/2017. Plaintiff's Motion 27 is GRANTED to the extent that it seeks to withdraw his previously filed Motion Demanding Defendants to Answer Complaint 25 . Plaintiff's motion 25 is withdrawn. Plaintiff files Motion to Request Counsel 26 . The Plaintiff has no constitutional or statutory right to counsel in this case. In considering the Plaintiffs motion, the court asks: (1) has the indigent Plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself? Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007), citing Farmer v. Haas, 990 F.2d 319, 322 (7th Cir.1993). Plaintiff has shown that he made a reasonable attempt to secure counsel on his own. Plaintiff has personal knowledge of the facts of this case, has adequately conveyed them to the Court, and this case does not appear to be overly complex or suggest that expert testimony is needed at this point. Plaintiff should be able to obtain relevant information through the discovery process. Therefore, the Court finds that Plaintiff is capable of representing himself at this time. Plaintiff's motion 26 is DENIED with leave to renew.(KB, ilcd) (Entered: 01/31/2017)" @default.
