Here, Plaintiff has been detained or incarcerated in three different states (Illinois, Virginia, North Carolina) during the relatively short time this case has been pending, the Defendants' motion to compel was still pending when Defendants' filed the motion to dismiss, and Plaintiff appears to have otherwise complied with the Court's orders. Therefore, Defendants' motion 41 is DENIED. If Plaintiff fails to comply with this Order, the Court will consider any sanction available under Rule 37 of the Federal Rules of Civil Procedure, including dismissal, upon a properly raised motion.
