On November 17, 2017, the Court held a hearing pursuant to Rule 16 of the Federal Rules of Civil Procedure. The Court noted that during the hearing, Defendant states he intends to take the deposition of Mental Health Worker Kelly Haag. Defendant is to direct Haag to bring any notes concerning conversations with the Plaintiff about his cell mate during the relevant time period. See November 17, 2017 Minute Entry. Plaintiff also agreed to a bench trial during the hearing. Plaintiff has now filed a motion for clarification asking if he will be allowed to attend the deposition of Haag 24 . In addition, the Defendant has also filed a motion to clarify the record indicating he no longer wishes to take the deposition of Haag, and he does not agree to a bench trial. 25 . Defendant's motion is granted as Defendant can choose who to depose. 25 .
