- ilcd;;1:16-cv-01378_de54 RegisterActionDescriptionText "TEXT ORDER entered by Judge Joe Billy McDade on 11/16/2018. The Court granted Defendant's motion for summary judgment and judgment entered on 10/16/18. On 11/9/18, Plaintiff filed 39 , requesting an extension in which to file a motion to reconsider the summary judgment order 37 . "A 'motion to reconsider' does not exist under the Federal Rules of Civil Procedure. Thus, a motion that seeks to challenge the merits of a ruling by a district court will automatically be considered as having been filed under Rule 59(e) or Rule 60(b) of the Federal Rules of Civil Procedure." Scott v. Bender, 948 F. Supp. 2d 859, 864 (N.D. Ill. 2013) (internal citation omitted). The Court, however, does not have the authority to extend the time for filing a 59(e) motion as Plaintiff requests. See Fed. R. Civ. P. 6(b)(2); Robinson v. Sweeny, 794 F.3d 782, 783 (7th Cir. 2015). 39 is DENIED. The Court notes that, even though Plaintiff is represented by counsel, he filed the motion pro se. Plaintiff is placed on notice that he is not to file motions on his own, as all filing are to be made through counsel. SEE 11/16/2018 AMENDED TEXT ORDER. (SAG, ilcd) Modified on 11/16/2018 to include language re the amended TO(JRK, ilcd). (Entered: 11/16/2018)" @default.
