- ilcd;;1:16-cv-01381_de74 RegisterActionDescriptionText "TEXT ORDER Entered by Judge Sara Darrow on 11/20/2017. In several motions (Docs. 34, 37, 39, 41, 46, 52), Plaintiff seeks a court order compelling Defendants to produce photos of his injuries, an x-ray report, administrative directives regarding cell extractions and suicide watch, video evidence, and the disciplinary history and grievances filed against each Defendant for the past 12 months. Plaintiff received a copy of the x-ray report. (Doc. 40 at 3). Defendants indicate that they have provided certain administrative policies pertaining to suicide watch and shakedown procedures, copies of incident reports from the relevant date, certain grievances related to the use of force, and Plaintiffs medical records. Defendants also indicate that the investigation into the alleged incident is still ongoing and that they will supplement their requests as information becomes available. Defendants were previously granted additional time to respond to Plaintiffs discovery requests and no new motions to compel have been filed. Accordingly, the Court finds that Defendants discovery responses have been appropriate, and the Court sees no reason to intervene. Plaintiffs motions (Docs. 34, 37, 39, 41, 46, 52) are therefore denied. Plaintiff also filed a Motion for Sanctions (Doc. 40) asking for a court order directing Defendants to pay $3,000.00 in sanctions for failure to produce his requested items. Rule 37(b)(2) authorizes a district court to issue further just orders upon a partys failure to obey an order to provide or permit discovery, and also order the disobedient party to pay reasonable expenses caused by the failure to follow the court order. Fed. R. Civ. P. 37(b)(2). The Court, however, has not entered any orders related to the conduct Plaintiff alleges, and, therefore, sanctions are not appropriate. Plaintiffs motion (Doc. 40) is denied. Defendants Motions for Extension of Time (Docs. 57, 58) are granted. Dispositive motions shall be filed by December 7, 2017.(ED, ilcd) (Entered: 11/20/2017)" @default.
