The Court does not have the authority to order an attorney to accept pro bono appointment on a civil case such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). In determining whether the Court should attempt to find an attorney to voluntarily take the case without pay, the question is "given the difficulty of the case, does the plaintiff appear competent to litigate it himself?" Pruitt, 503 F.3d at 654-55 (7th Cir. 2007). On this record, Plaintiff appears competent to proceed pro se. Though his claim is about a medical condition AC joint separation he will not necessarily need an expert to show deliberate indifference. See Ledford v. Sullivan, 105 F.3d 354, 359 (7th Cir. 1997)(court appointed expert not necessary to assist jury in deciding issue of deliberate indifference on particular facts of case). Plaintiff should be able to obtain his medical records and the recommendations from the outside consultants, which Plaintiff alleges were not followed. Plaintiff also can testify personally to the pain he has experienced and his difficulty functioning. Plaintiff asserts that he needs to conduct depositions of Defendants, but Plaintiff may instead send written interrogatories to Defendants asking Defendants to explain the basis for their decisions. If Defendants do not respond, Plaintiff may file a motion to compel. Plaintiff may renew his motion on a more developed factual record if he is having difficulty obtaining the information he seeks in discovery.
