- ilcd;;1:16-cv-01473_de70 RegisterActionDescriptionText "TEXT ORDER entered by Judge Michael M. Mihm on 3/21/2018. Plaintiff files a motion to compel 50 to which Defendants have filed a response and objection. Defendants assert that they timely responded to Plaintiff's request to admit and requests for production of documents, producing 751 pages of medical records. Defendants also timely responded to the interrogatories served on each of them. They, in fact, sent additional copies of discovery after Plaintiff alleged that his copies had been destroyed. Defendants also address Plaintiff's claim that they did not timely serve their initial disclosures. They note that their initial disclosures were due February 26, 2018, and mailed the following day, still timely under the 3-day "mailbox rule." They assert that Plaintiff's subsequently filed "First Request for Documents for Defendant's to Produce Plaintiff Initial Disclosure," are actually Plaintiff's initial disclosures, to which Defendants are not required to respond. The Court finds Defendants' response to the various requests to be sufficient. Plaintiff's motion to compel 50 is DENIED. In their response, Defendants raise the objection that Plaintiff has made multiple requests for additional copies of his and Defendants' filings. They assert that this has been Plaintiff's pattern in this and other cases. Defendants assert that it is not their responsibility to finance Plaintiff's litigation and ask that Plaintiff be admonished by the Court. The Court has already noted that, despite being given 751 pages of medical records, Plaintiff had asked the Court to issue a subpoena for these same records. Plaintiff is showing a troubling tendency to burden Defendants and the Court with repetitive requests. Plaintiff is to refrain from such conduct in the future, or face sanctions.(JS, ilcd) (Entered: 03/21/2018)" @default.
