The Court reviewed the basis of any anticipated Daubert Motions and Motions for Summary Judgment. Defendants' Motion to Join the Co-Defendants' Response is granted. 473 . Plaintiff's Motion for a Briefing Schedule is granted in part and denied in part. 471 . The Court will set a briefing schedule, but based on the information provided during the hearing, the Court will not address potential Daubert Motions prior to Summary Judgment. Defendants' Motion for An Extension of Time is also granted. 474 . Therefore, any Daubert Motions or Motions for Summary Judgment must be filed on or before September 1, 2021; any response to a Summary Judgment Motion or Daubert motion must be filed on or before September 29, 2021, and any reply to a Summary Judgment response, if necessary, must be filed on or before October 6, 2021. The pretrial and trial dates remain as set. The Court also admonished the parties any briefing provided MUST stick to the specific topic. A Daubert Motion must only address the admissibility of expert testimony pursuant to Federal Rule of Evidence 702 and the Supreme Court's opinion in Daubert v. Merrell Dow Pharms., Inc., 509 U.S. 579 (1993). The parties must not address previous rulings or issues for summary judgment. In addition, the Court has previously admonished the parties it will not accept the confused and convoluted briefing it has previously received at summary judgment. See April 20, 2021 Summary Judgment Order, p. 9. The Court has provided a list of instructions which must be followed in any future dispositive motion. See April 20, 2021 Summary Judgment Order, p. 9-10. "If either party fails to follow these directions, the Court will strike the briefing and allow seven days to comply with the Court's order."
