Provident Consumer Discount Co., 459 U.S. 56, 58 (1982)(holding that, generally, the filing of a notice of appeal "is an event of jurisdictional significance" that "confers jurisdiction on the court of appeals and divests the district court of its control over those aspects of the case involved in the appeal."). Therefore, Plaintiff cannot amend his complaint at this time. To the extent that Plaintiff wanted to file a new case, he must re-submit his complaint without this case number associated with it. In addition, Plaintiff must either pay the filing fee for a new case or move for leave to proceed in forma pauperis in that new case. If Plaintiff files another case, he will be responsible to pay the entire filing fee in this case, in the new case, and in the appeal pending before the United States Court of Appeals for the Seventh Circuit.
