- ilcd;;1:17-cv-01176_de72 RegisterActionDescriptionText "TEXT ORDER entered by Judge Colin Stirling Bruce on 7/25/2018. Plaintiff's motion to reconsider 55 is DENIED. Essentially, Plaintiff argues that the Court erred in each of its Orders that ruled against him. In short, Plaintiff claims that the Court got it wrong. However, the Court provided an explanation and its reasoning for each of its Orders, including Judge Baker's Order that required Plaintiff to amend after he filed a 390-page complaint. The Court stands by its prior Orders, including its conclusion that Defendants would suffer undue and unfair prejudice if Plaintiff were allowed to amend his complaint at this late date. Contrary to Plaintiff's assertion, the Court is not required to search through Plaintiff's exhibits to determine potential defendants and potential claims. Chaney v. Wal-Mart Stores Inc., 2016 WL 4083502, * 3 (W.D. Okla. Aug. 1, 2016)(The Court cannot serve as an advocate for Plaintiff and search his exhibits for a plausible basis for his claims.); Garrett v. Selby Connor Maddux & Janer, 425 F.3d 836, 840-41 (10th Cir. 2005)(holding that the court cannot advocate parties, even those proceeding pro se, and is not responsible for searching the record in support of plausible theories). Therefore, Plaintiff's motion to reconsider is denied. In addition, Plaintiff's fourth motion for counsel 56 is also DENIED. As the Court has previously explained to Plaintiff, the test for determining whether the Court should attempt to recruit counsel for a pro se litigant is not whether an attorney could do a better job litigating the case. DeWitt v. Corizon, Inc., 760 F.3d 654, 657 (7th Cir. 2014). The test is whether Plaintiff is capable of litigating the case himself. Pruitt v. Mote, 503 F.3d 647, 655 (7th Cir. 2007). Plaintiff has shown himself to be capable, and therefore, his motion is denied. (KE, ilcd) (Entered: 07/25/2018)" @default.
