- ilcd;;1:17-cv-01263_de14 RegisterActionDescriptionText "TEXT ORDER entered by Judge Colin Stirling Bruce on 8/23/2017. Plaintiff's motion for leave to file amended complaint 10 is DENIED. Plaintiff seeks leave to file an amended complaint to state a First Amendment retaliation claim against Mike Melvin, J. Janes-Melvin, A. Joyner, and G. Kochel. In his proposed Amended Complaint, Plaintiff alleges that these individuals have retaliated against him because he filed grievances and because he was successful in having his disciplinary ticket overturned as a result of those grievances. Specifically, Plaintiff alleges that these individuals retaliated against him by denying him job assignments and by denying him a transfer to a different facility because he succeeded in having his disciplinary ticket expunged from his record. However, Plaintiff's allegations of retaliation are based upon actions allegedly taken against him after his disciplinary ticket was expunged. The claims asserted by Plaintiff in his Original Complaint are based upon actions allegedly taken by Defendants before his ticket was expunged. As a result, Plaintiff's retaliation claim is un-related to the claims asserted in his Original Complaint. Fed. R. Civ. Pro. 18-20. Recently, the United States Court of Appeals for the Seventh Circuit has reminded district courts that unrelated claims asserted against unrelated defendants may not proceed in a single case. Owens v. Godinez, 2017 WL 2540616 (7th Cir. June 12, 2017). Accordingly, if Plaintiff wants to assert a First Amendment claim against Mike Melvin, J. Janes-Melvin, A. Joyner, and G. Kochel as alleged in his proposed Amended Complaint, he must file a second suit, and he must pay a second filing fee in order to do so. (DS, ilcd) (Entered: 08/23/2017)" @default.
