On July 1, 2020, the Court allowed Defendants the opportunity to file a second dispositive motion on or before August 14, 2020. See July 1, 2020, Minute Entry. Plaintiff then filed a motion to intervene stating he has been transferred to a new facility after the hearing, and he did not have the documents needed to respond to the motion 126 . Defendants were directed to provide a response on or before August 14, 2020. See August 3, 2020, Text Order. Defendants have now complied with the Court's order. (Def. Resp., 129 ). Defense counsel has contacted the litigation coordinator at Plaintiff's current facility, Dixon Correctional Center, and Plaintiff's former facility, Menard Correctional Center. Each confirms Plaintiff's documents have not been transferred due to "current COVID-19 conditions." (Def. Resp., 129 , p. 1). Plaintiff's former facility indicates the documents will be transferred "once transfers fully resume and a bus or property truck" is going to Dixon. (Def. Resp., 129 , p. 2). Furthermore, the Menard Litigation Coordinator states "every attempt will be made to send the legal materials in the next two weeks." (Def. Resp., 129 , p. 2). However, "due to the ever changing COVID-19 conditions, including the need to quarantine offenders and their materials upon arrival to the institutions, the estimated time could change." (Def. Resp., 129 , p. 2). Defense counsel states she will advise the court once there is an estimated delivery time. The Court previously set a 30-day deadline for Plaintiff to file his response to the pending motion for summary judgment. See July 1, 2020, Minute Entry. Clearly, Plaintiff cannot meet that deadline. The Court appreciates the efforts of defense counsel to provide additional information, but the Court cannot set a realistic deadline for a response to summary judgment until Plaintiff has received his legal boxes. Therefore, the Court will ask defense counsel to provide a further, written update on September 4, 2020, indicating whether Plaintiff now has access to his legal documents. Plaintiff does not need to file a response until the new deadline is set. The Clerk is to provide a copy of this order to the attention of the litigation coordinators at both Menard and Dixon Correctional Centers.
