- ilcd;;1:17-cv-01286_de24 RegisterActionDescriptionText "TEXT ORDER entered by Chief Judge James E. Shadid on 7/5/2018. Plaintiff alleges three Defendants including Officer John Doe violated his rights based on his living conditions from August 2013 to May 2016. The Court has asked Defendants whether they can identify the John Doe Defendant based on the allegations in his complaint. Specifically, Plaintiff says the Defendant worked the 7-3 shift, was 6' to 6'2" inches tall, white, in his late 30's to 40's, had a military haircut and still works at Pontiac. (Comp., p. 3). Plaintiff's complaint also repeatedly provided specific dates he complained to Officer John Doe. (Comp., p. 5, 6, 7, 8). Defendants have now provided a response stating there were five males assigned to Plaintiff's gallery in March of 2016. Therefore, they ask Plaintiff to specify the dates he spoke to the officer in March. 21 . Defendants' response is insufficient. Plaintiff has provided several dates in March and other months in the complaint to the Defendant, and he has provided a specific, physical description. Nonetheless, the Court will ask Plaintiff to provide an updated written response within 7 days noting whether he has any additional information to assist in identifying his John Doe Defendant. Based on this information and the information already provided by Plaintiff, Defendants must provide an updated response, in writing, within 14 days stating whether they can identify the proper individual. If they are unable to identify the John Doe, Defendants must state why the physical description and various dates provided are insufficient. See Donald v. Cook County Sheriff's Dept., 95 F.3d 548, 556 (7th Cir.1996) ("Depending on the particular circumstances of the case, the court may assist the plaintiff.. by ordering the named defendants to disclose the identities of unnamed officials involved; by ordering service on all officers who were on duty during the incident in question; or by some other means.")(SAG, ilcd) (Entered: 07/05/2018)" @default.
