- ilcd;;1:17-cv-01292_de34 RegisterActionDescriptionText "TEXT ORDER entered by Judge Joe Billy McDade on 8/15/2018. Plaintiff files 25 , requesting the recruitment of pro bono counsel. The Court does not possess the authority to require an attorney to accept pro bono appointments on civil cases such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). The most that the Court can do is to ask for volunteer counsel. In determining whether the Court should attempt to find an attorney to voluntarily take a case, the question is whether the plaintiff appears competent to litigate his own claims, given their degree of difficulty, and this includes the tasks that normally attend litigation: evidence gathering, preparing and responding to motions and other court filings, and trial. Pruitt at 655. Plaintiff requests that counsel be appointed so that he may obtain surveillance video footage and the names and statements of "MSU workers." While Plaintiff claims that "defendants will and cannot give this video surveillance to plaintiff because of treat (sp) to security," it is not clear that he has requested this information in discovery. If Plaintiff has need of this information, he is to request it in discovery. If Defendants refuse to provide it, Plaintiff may file a Motion to Compel. If Defendants assert safety and security concerns, the Court will review to determine whether an in camera inspection is warranted. 25 is DENIED. (VH, ilcd) (Entered: 08/15/2018)" @default.
