Upon review, the Court corroborates that defense counsel has a conflict with a jury trial before Judge Colin Bruce, Hughes v. Bolte (19-cv-1106), which was scheduled some two and 1/2 months prior to this case. Accordingly, 51 is GRANTED as the pending trial date and final pretrial dates are VACATED and the previously issued video writ for final pretrial conference is RECALLED. Defense counsel is, within 14 days, to identify 4 or 5 alternate trial dates for rescheduling the trial. Plaintiffs oral motion for recruitment of pro bono counsel is DENIED. As the Court previously noted, Plaintiff is proceeding against one Defendant on a claim of excessive force. Plaintiff has direct, first-hand knowledge of the alleged events. Furthermore, the allegations do not concern complex matters or issues which involve expert testimony. Plaintiff has been well-able to represent himself so far and the Court sees no detriment in his continuing to act on his own. The Court now considers Plaintiff's 50 , motion for subpoena in which he requests that subpoenas issue for the trial testimony of inmate witnesses Tramain McDonald, Juan Starks and Robert Williams. As Plaintiff was advised in the Court's 1/19/21 order, he may identify those inmate witnesses in the proposed final pretrial order and the Clerk will issue writs for their video appearance at trial. 50 is, therefore, DENIED. In 49 , Plaintiff asks that the affidavits of Tramain McDonald, Juan Starks and Robert Williams be admitted at trial. 49 is DENIED as such testimony would be irrelevant and redundant as these individuals are expected to testify in person. Plaintiff has also filed a motion to compel 48 , with the response not yet due. Defendant will have an additional 7 days, until 5/4/21, in which to file a response.
