- ilcd;;1:17-cv-01323_de72 RegisterActionDescriptionText "TEXT ORDER: Plaintiff's motions for the Court to attempt to recruit pro bono counsel to represent him are denied. (d/e's 37 , 59 .) The Court cannot order an attorney to accept pro bono appointment on a civil case such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). Plaintiff has made reasonable efforts to find counsel, so the question is "whether the difficulty of the casefactually and legallyexceeds the particular plaintiff's capacity as a layperson to coherently present it to the judge or jury himself." Pruitt, 503 F.3d at 655 (7th Cir. 2007). On this record, Plaintiff appears competent to proceed pro se. His pleadings adequately convey the factual basis for his relatively simple claims of excessive force and indifference to the injuries from that excessive force. Plaintiff already has personal knowledge of the relevant facts underlying both of those claims. Plaintiff also has extensive federal litigation experience, having pursued 20 cases in federal court since 2008. Plaintiff asserts he performs academically at a fifth grade level, but Plaintiff's pleadings demonstrate that he is good at writing and knowledgeable about federal law and civil procedure. Plaintiff has filed many pleadings, including a motion to compel, affidavits, a motion to amend, a motion for default, and motions for reconsideration, all of which appear to be written in Plaintiff's own handwriting. On a separate matter, Defendants' motion to extend discovery and dispositive motion deadlines is granted. (d/e 58 .) The discovery deadline is extended to November 30, 2018. The dispositive motion deadline is extended to December 28, 2018. A separate order will enter on the other pending motions. Entered by Magistrate Judge Tom Schanzle-Haskins on 9/14/2018. (MAS, ilcd) (Entered: 09/14/2018)" @default.
