- ilcd;;1:17-cv-01467_de41 RegisterActionDescriptionText "TEXT ORDER entered by Judge Michael M. Mihm on 1/4/2019. Plaintiff files 30 requesting that the Clerk send him a copy of Defendants' Motion for Sanctions 23 so he might file a response. The Court, however, denied Defendants' Motion on 10/29/18, so no response is needed. Nonetheless, the Clerk is directed to send Plaintiff a copy of the Motion. 30 is GRANTED. A duplicate copy of Plaintiff's 30 was filed as 32 and is rendered MOOT. Plaintiff files 31 , a motion for recruitment of pro bono counsel. Plaintiff asserts that he is seriously mentally ill and unable to proceed on his own. The Court does not possess the authority to require an attorney to accept pro bono appointments on civil cases such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). The most that the Court can do is to ask for volunteer counsel. Jackson v. County of McLean, 953 F.2d 1070, 1071 (7th Cir. 1992)(holding that it is a fundamental premise that indigent civil litigants have no constitutional or statutory right to be represented by counsel in federal court.). In determining whether the Court should attempt to find an attorney to voluntarily take a case, the question is whether the plaintiff appears competent to litigate his own claims, given their degree of difficulty, and this includes the tasks that normally attend litigation: evidence gathering, preparing and responding to motions and other court filings, and trial. Pruitt at 655. The Court recently ruled on Plaintiff's prior request for counsel noting that thus far, Plaintiff has exhibited the ability to proceed on his own. See 12/20/18 text order. Plaintiff offers nothing new to establish that his mental illness prevents him from proceeding. 31 is DENIED. A duplicate copy of 31 , filed at 33 , is rendered MOOT.
