- ilcd;;1:17-cv-01488_de18 RegisterActionDescriptionText "TEXT ORDER entered by Judge Michael M. Mihm on 12/22/2017. Plaintiff's motion for leave to file an amended complaint 16 , is hereby GRANTED. The clerk is directed to file the amended complaint, set a merit review deadline 30 days out and vacate the prior deadline. Plaintiff has filed 7 , 11 , 12 , 13 , 14 and 15 , informing the Court of various incidents which had occurred since he filed his complaint. In 7 , Plaintiff complains that the Pontiac staff refused to file the exhibits to his complaint. The docket clearly shows, however, that Plaintiff's complaint was filed on November 1, 2017, with three attached exhibits, totaling 75 pages in all. Plaintiff does not claim that he filed additional exhibits which are not contained in the record. 7 is DENIED. In 11 , Plaintiff asks that the Court order an investigation into his claim that Sergeant Dillon assaulted him on November 12, 2017. It is not the Court's prerogative, however, to order an IDOC investigation. Furthermore, this an unrelated claim and is more properly filed as a separate lawsuit. See George v. Smith, 507 F.3d 605, 607 (7th Cir. 2007), "[u]nrelated claims against different defendants belong in different suits." The Court, will, however order that Pontiac preserve the 11/12/17 video of North House cell #137. The Clerk is directed to send a copy of this order to the Pontiac Warden, or his designee. The Warden or designee, is to file a response within 21 days, informing the Court whether there is such a video and where it is being kept. 11 is otherwise DENIED. In 12 , Plaintiff alleges that he is seriously mentally ill (SMI), and that long-term placement in segregation has caused his mental state to deteriorate. Plaintiff requests injunctive relief as to this claim. Plaintiff, however, is a class member in Rasho v. Walker, No. 07-1298 (C.D.Ill. Nov. 7, 2007) in which the same claims are alleged. 12 is DENIED as redundant to the claims in the ongoing Rasho case. In 13 , Plaintiff alleges that med tech Sabrina refused to give him his medication on 11/27/17. In 14 , he alleges that on 11/27/17, he was denied his out- of- cell time. In 15 , he complains that Director B1B6421 did not follow-up his grievance alleging an 11/12/17 assault by Sgt. Dillon. As indicated, however, these claims are not related to the underlying action and 13 , 14 and 15 are DISMISSED for misjoinder. (JS, ilcd) (Entered: 12/22/2017)" @default.
