At merit review, the Court dismissed one of Plaintiff's claims which requested injunctive relief which would stop the practice of holding seriously mentally ill (SMI) inmates in long-term segregation. The claim was dismissed as Plaintiff is a class member in Rasho v. Walker, No. 07-1298 (C.D.Ill. Nov. 7, 2007) where the same claims for injunctive relief are being litigated. Plaintiff files 18 indicating that he wishes to opt out of the Rasho class and seek injunctive relief here. Plaintiff, however, cannot "opt out" because the Rasho class was certified under Rule 23(b)(2) which does not allow it. Fed. R. Civ. P. 23(c)(2); Lewis v. City of Chicago, 702 F.3d 958, 962 (7th Cir. 2012) ("no one can opt out of a (b)(2) class"). 18 is DENIED. Plaintiff files 19 , reasserting his request for an 11/12/17 cell video which will allegedly show Officer Dillon retaliating against him. On 12/22/17, the Court had ordered the Pontiac Warden, Michael Melvin, to determine whether the video existed. Defendant Melvin filed a response on 1/16/18, indicating that the video had been overwritten by the time he received the Court's order. 19 is rendered MOOT.
