- ilcd;;1:17-cv-01579_de8 RegisterActionDescriptionText "TEXT ORDER entered by Chief Judge James E. Shadid on 3/28/2018. Plaintiff has filed a complaint pursuant to Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388(1971) against several federal correctional staff members at a variety of institutions including FCI Pekin. Plaintiff alleges an unconstitutional policy which discriminates against male inmates by allowing female guards to conduct pat down searches. Plaintiff also alleges the searches violate his religious rights. Plaintiff has further filed a motion to amend his complaint to add additional First and Eighth Amendment claims based on the cross-gender searches. The Court does not allow piecemeal amendments, and therefore the motion to amend is denied. 7 . More important, Plaintiff admits he has accumulated three strikes pursuant to 28 U.S.C. 1915(g). See BB148EC v. Geit, Case No. 11-134 (W.D.Wis.) (revoking IFP status due to three strikes status). Plaintiff's claims clearly do not fit the standard of "imminent danger of serious physical injury" required to proceed in forma pauperis. 28 U.S.C. 1915(g). Therefore, Plaintiff's motion to proceed IFP is denied. 3 . Plaintiff must pay the full $400 filing fee within 14 days or his case will be dismissed. Plaintiff's motion for status update is also denied as moot. 8 (JRK, ilcd) (Entered: 03/28/2018)" @default.
