(D. 32 ). The Petitioner sought leave from the Seventh Circuit Court of Appeals to file a successive petition. See Case No. 18-1346, (D. 1). The Appellate Court disagreed with this Court's ruling and directed that Petitioner's motion for leave be filed as an initial pleading in this Court. See Case No. 18-1346, (D. 2). The Petitioner's arguments in both cases are the same. At the Petitioner's request, the Court terminated Case No. 18-1346 in order to proceed on the merits of his claims in this matter. Given the Seventh Circuit's finding, the Petitioner is entitled to a ruling on the merits in this case. Therefore, 35 his Motion to Vacate, is hereby GRANTED. The Clerk is directed to VACATE 33 , the judgment in this case, and reopen this matter. The Court will address the remaining pending motions in this matter in due course.
