- ilcd;;3:16-cv-03014_de0 RegisterActionDescriptionText "Remark (Text Order filed in 15-3332 on 1/20/2016): TEXT ORDER: On December 8, 2015, this Court granted Plaintiff 31376E7 leave to proceed in forma pauperis against Defendants Joshoua Sproat, Kimberly Allen, Bonnie Lindenhour, and Kelli Bruhn on 31376E7 familial relations substantive due process claim brought pursuant to 42 U.S.C. § 1983 and state law intentional infliction of emotional distress claim. See Opinion 5. The Court dismissed Plaintiff 31376E7 claims against several other defendants and dismissed all of Plaintiff 15F1FE1 claims. The Court granted Plaintiffs leave to file an amended complaint. The Court specifically advised Plaintiffs that an amended complaint completely replaces the original complaint. On December 16, 2015, Plaintiffs filed an Amended Complaint 6. On December 23, 2015, Plaintiffs filed another Complaint 8 against several individuals alleging primarily a false arrest claim. Plaintiffs also filed a motion to proceed in forma pauperis 10 and motions to request counsel 9, 11. The Court interprets the December 23 Complaint as a new claim in light of the fact that it raises a different cause of action and Plaintiffs filed new motions to proceed in forma pauperis and requests for counsel. It does not appear that Plaintiffs intended to abandon the claims raised in their Amended Complaint. Therefore, the Clerk is DIRECTED to STRIKE docket entries 8, 9, 10, and 11 from Case No. 15-3332 and open a new case with those four documents. Plaintiffs have also filed a request for status 13.
