If Plaintiff believes that Defendant has not provided a document or information that is responsive to his discovery request(s), he should file a motion to compel under Federal Rule of Civil Procedure 37, should attach a copy of his discovery request and Defendant's response thereto that he claims is insufficient, and should explain to the Court why Defendant's response is insufficient. Plaintiff's motion for issuance of subpoena 37 is also DENIED as moot. Plaintiff has acknowledged that Defendant has provided Plaintiff's medical records to him. To the extent that the records that Plaintiff wants to obtain via a subpoena were not a part of that disclosure, Plaintiff must first submit a discovery request for those documents to Defendant before the Court will involve a non-party in the discovery process.
