- ilcd;;3:17-cv-03212_de35 RegisterActionDescriptionText "TEXT ORDER: Plaintiff has filed an "emergency motion to compel Defendants to administer medical care." (d/e 23 .) Defendants' motion to extend their deadline for responding is granted. (d/e 24 .) Defendants' response has been filed. Plaintiff seeks, among other things, referral to an outside doctor or clinic for a pain evaluation. "'[A] preliminary injunction is an exercise of a very far-reaching power, never to be indulged in except in a case clearly demanding it.'" Girl Scouts of Manitou Council, Inc. v. Girl Scouts of U.S. of America, 549 F.3d 1079, 1085 (7th Cir. 2008)(quoted cites omitted). To obtain a preliminary injunction, a plaintiff must show that he is "likely to succeed on the merits,... likely to suffer irreparable harm without the injunction, that the harm he would suffer is greater than the harm that the preliminary injunction would inflict on the defendants, and that the injunction is in the public interest." Judge v. Quinn, 612 F.3d 537, 546 (7th Cir.2010). Plaintiff has not demonstrated any of these requirements. According to the affidavit of Plaintiff's treating prison doctor, Plaintiff has degenerative disc disease and is already taking Tylenol 3 and Tramadol, which Dr. Nawoor believes should sufficiently control Plaintiff's pain. (Dr. Nawoor Aff.). Dr. Nawoor avers that Plaintiff "has a history of polysubstance abuse" and that Dr. Nawoor has not observed Plaintiff to be in debilitating pain. The Court is not deciding the merits of Plaintiff's claim, but at this point Plaintiff has not demonstrated why the merits of his claim cannot be decided in the regular course of litigation. Plaintiff's motion is denied. (d/e 23 .) Defendants' motion to extend the dispositive motion deadline is granted. (d/e 30 .) The dispositive motion deadline is extended to July 25, 2018. Entered by Judge Sue E. Myerscough on 6/26/2018. (GL, ilcd) (Entered: 06/26/2018)" @default.
