- ilcd;;4:16-cv-04024_de79 RegisterActionDescriptionText "TEXT ORDER entered by Judge Colin Stirling Bruce on 6/28/2017. Plaintiff files 60 , identified as a motion for preliminary injunction but which is really an objection to Defendants' request for an extension in which to file dispositive motions 58 . Defendants had requested an extension, as they had not yet received the deposition transcript from the court reporter. Plaintiff claims that Defendants have been dilatory in this case, have obtained several extensions, and rescheduled his previously cancelled deposition only five days before the discovery cutoff. Plaintiff claims, generally, Defendant's actions are "illegal" and undertaken in bad faith. He requests injunctive relief, denying the extension. He also claims that Hill Correctional Officer Gutierrez and Vorgias, not parties, have interfered with his ability to pursue his lawsuits and, that on April 24, 2017, Officer Gutierrez confiscated his legal documents some of which have not been returned to him. 60 is MOOT to to the extent that Plaintiff does not plead irreparable harm to support a claim for injunctive relief. See Ty, Inc. v. Jones Group, Inc., 237 F.3d 891, 895 (7th Cir. 2001) (a party seeking the injunction has the burden to prove that he will suffer irreparable harm during the time prior to final resolution of his claims, the inadequacy of legal remedies available, and some likelihood of success on the merits). It is also MOOT as the Court has already granted Defendants' request for an extension. To the extent that Plaintiff claims that other individuals are infringing upon his constitutional rights, he may not add unrelated claims against new defendants in this action. If Plaintiff wishes to pursue this matter he must file a separate complaint, and pay the required filing fee. George v. Smith, 507 F.3d 605, 607 (7th Cir. 2007) ("Unrelated claims against different defendants belong in different suits.") (JMB, ilcd) (Entered: 06/28/2017)" @default.
