Prison officials from Vandalia Correctional Center are not a party to this lawsuit, and the facility itself is located in Fayette County, Illinois, which is not part of this judicial district. See 28 U.S.C. Sec. 93(c). Furthermore, "expenditure of public funds is proper only when authorized by Congress." U.S. v. MacCollom, 426 U.S. 317, 321 (1976). The Court is unaware of any statutory authority that permits it to advance litigation costs to an indigent litigant in this type of case. Plaintiff's Motion 28 is therefore DENIED. Plaintiffs Motion to Reconsider 27 is DENIED. If Plaintiff seeks to add new claims and defendants, he must file a motion for leave to file an amended complaint with a proposed amended complaint attached to the motion.
