Plaintiff alleges that Defendant Brady trespassed on his yard, stole a bag of garbage, and then used the contents of the garbage bag to obtain a search warrant. Plaintiff alleges that, at the time of execution, the search warrant lacked particularity in describing the place to be searched, had expired, and was otherwise facially defective. Defendants have not opposed this motion. Therefore, Plaintiff's motion 34 is GRANTED. The Court finds that Plaintiff states a Fourth Amendment claim based upon Defendant Brady's actions in obtaining the search warrant and his actions in its execution. Plaintiffs request to add "Employees of Knox County Sheriff's Department" as defendants on the basis that they "are eligible to be held accountable for [their] employees action" is denied. See Ashcroft v. Iqbal, 556 U.S. 662, 676 (2009) (no respondeat superior liability in Section 1983 actions). Defendant's Motion to Vacate and Reset Deadlines 36 is GRANTED. Discovery shall be completed by May 22, 2018. Dispositive motions shall be filed by June 22, 2018. Plaintiff's Motion for a Status Hearing 35 is DENIED.
