- ilcd;;4:16-cv-04127_de102 RegisterActionDescriptionText "TEXT ORDER entered by Chief Judge James E. Shadid on 2/7/2019. Plaintiff has one claim before the Court alleging five Defendants at Rushville Treatment and Detention Center used excessive force against him on February 21, 2016. Plaintiff has now filed a motion entitled Motion to Give Judicial Notice. Plaintiff states all of the Defendants have committed unspecified crimes. It is unclear what crimes Plaintiff is alleging since he provides no factual basis for his allegations. Furthermore, this Court cannot order that criminal charges be filed against anyone. Criminal prosecutions are the function of state and federal prosecutorial authorities. Plaintiff next alleges in January of 2019 one of the Defendants "got in his face" while he was having his blood pressure checked. (Mot, p. 3). Plaintiff says he is informing the Court because he intends to raise this and similar issues at trial. First, Plaintiff must address his complaints about staff at his facility, not with the Court. Second, the Federal Rules of Civil Procedure prohibit Plaintiff from raising or addressing any issues at trial that are not directly related to the one incident of excessive force on February 21, 2016. See Fed.R.Evid. 404. Plaintiff's motion is not an appropriate filing and is denied 68 . (SAG, ilcd) (Entered: 02/07/2019)" @default.
