Shadid for telephonic Status Conference held on Thursday, 9/27/2018: This cause is before the Court for a telephone status hearing. Defendant was represented by Attorney Alexandra Rice. Plaintiff failed to appear. This hearing was originally set for September 14, 2018 at 11:00 a.m. See August 3, 2018 Text Order. However, during the week of the hearing, the Court attempted to reset the time of the hearing due to a conflict. Multiple messages were left at the phone number Plaintiff provided to the Court without response. Therefore, the Court reset the hearing for September 27, 2018 and provided written notice to the parties of the new day and time. See September 13, 108 Text Order. Plaintiff was advised hearings were set by telephone to avoid requiring Plaintiff to travel from Chicago, Illinois to Peoria, Illinois. Therefore, Plaintiff was admonished he must be available at the phone number provided and if he failed to participate in the September 27, 2018 hearing, his case could be dismissed with prejudice. See September 13, 2018 Text Order. Today, the Court attempted to reach Plaintiff without success at two separate telephone numbers Plaintiff had previously provided to the Clerk of the Court. In addition, when the Clerk called the number associated with Plaintiff's current address, an individual stated Plaintiff no longer lived there, and provided the clerk with a third telephone number. The Court also tried this number without success. Plaintiff has been warned on multiple occasions that he must IMMEDIATELY inform the Court of any change in his mailing address or phone number or his case could be dismissed. See May 30, 2017 Order, p. 5; August 23, 2017 Scheduling Order, p. 8; August 3, 2018 Text Order; August 28, 2018 Text Order. Therefore, Plaintiff's case is dismissed with prejudice for failure to follow Court orders and failure to prosecute with due diligence pursuant to Federal Rule of Civil Procedure 41(b).
