Holderman : The parties and counsel are now fully apprised of the well-reasoned rulings issued by Magistrate Judge Cole on October 16, 2006 (Dkt. No. 126), October 17, 2006 (Dkt. No. 132) and also on October 18, 2006 (Dkt. No. 135). Each party by both rule, Fed. R. Civ. P. 72(a), and statute 28 U.S.C. ?636(6)(b)(1) has ten days from the date of receiving the rulings to file objections thereto. Computing that period under Fed. R. Civ. P. 6(a) the date for objections falls on or after the scheduled date for the trial of this case. Consequently, this court believes that it would be in the best interest of the parties for the court to vacate the current trial date to allow the parties to consider and file any objections, and allow them to pause and focus on a possible compromise resolution of this case. Consequently, the court sua sponte vacates the trial date and time of a October 30, 2006 at 9:00 a.m., and the pretrial conference date of October 25, 2006 at 4:00 p.m., and requests the parties and counsel to meet with one another on or before October 25, 2006 at 4:00 p.m. to discuss settlement. The court also requests, if the parties do not settle the case, that by no later than 4:00 p.m. on October 27, 2006 counsel for each side deliver to Chief Judge Holderman?s chambers, room 2548, a written statement of their respective client's settlement position and the reasons supporting that position. A copy of that statement should be also delivered to opposing counsel at that same date and time. Counsel and persons with settlement authority for the parties are requested to attend a settlement conference with Chief Judge Holderman in Courtroom 2541 at 10:00 a.m. on October 30, 2006.
