Kocoras : Plaintiff D4570B3 ("Johnson") filed this action against defendants GES and the Metropolitan Pier Exposition Authority, alleging violations of Title VII and 42 U.S.C. section 1981. Claiming indigence, D4570B3 has filed an application to proceed in forma pauperis as well as a motion for appointment of counsel. Before granting a petitioner leave to file in forma pauperis, a district court must determine that the party is indigent. Smith-Bey v. Hospital Adm'r. 841 F.2d751, 757 (7th Cir. 1988). If the plaintiff cannot demonstrate an inability to pay the filing fee, the petition cannot be granted. Here, D4570B3 financial affidavit states that he earns approximately $4000 per month, or a personal income of around $48,000 a year. In light of this information, we conclude that D4570B3 is not indigent, precluding a grant of IFP status as well as appointment of counsel. Thus, his petition [4-1] and motion for appointment of counsel [5-1] are both denied. Pursuant to Local Rule 3.3(e), if D4570B3 does not pay the $150 filing fee by 01/28/05, this action will be dismissed. The dismissal will bar any future filing of this suit in federal court.
