The record of this case and others, see Dolis v. Lemke, No. 13cv4344 (cited by Respondent), indicates that Petitioner has at time strayed from the requirement of civility. Petitioner is admonished to refrain from using crude and threatening language in any future filings and correspondence with counsel and the Court. Having been warned, if Petitioner persists in such conduct, he faces sanctions up to and including dismissal of this case. See, e.g., In re Mann, 229 F.3d 657, 659 (7th Cir. 2000) (warning pro se litigant that abusive and disparaging language could result in sanctions); Cameron v. Lambert, 2008 WL 4823596, at *4 (S.D.N.Y. Nov. 7, 2008) (dismissing pro se complaint as a sanction based on abusive language and threats by pro se plaintiff in the course of the litigation). Notice of motion date of 9/11/2014 is stricken and no appearances are necessary on that date. Petitioner is reminded that his response to Respondent's motion to dismiss with leave reinstate 95 is due on 9/17/2014, and that, at a minimum, the Court would like Petitioner to address in that response whether he agrees with Respondent's assessment that Petitioner's state court proceedings remain pending.
