Plaintiff 2581177 has filed a "Memorandum in Opposition to the Motion" of defendants' motion for additional time to answer or otherwise plead in response to the complaint. This court routinely grants such motions by recently-served defendants at the commencement of litigation and will do so in this case. Plaintiff has in his response requested various types of affirmative relief such as a writ of mandamus, an order granting him leave without pay during the pendency of this case, and the correction of various misspellings in the complaint. This court will not consider the grant of affirmative relief requested in a response. Any affirmative order requested of the court must be requested by motion with notice to the opposing party. Except for the misspellings, plaintiff appears to desire some sort of injunction. Without considering in any way the issue of whether or not plaintiff is entitled to any such relief, the plaintiff is advised that should he wish to proceed on a motion for an injunction, he will have to carry a very heavy burden of demonstrating his entitlement to such relief with evidence presented at an evidentiary hearing.
