Grady : Plaintiff 2D9062A filed a pro se complaint in which she alleges that she is homeless and was sleeping in a chair at O'Hare Airport on March 14, 2005. Chicago police officers approached her, issued her a citation for violation of a city trespassing ordinance, and escorted her off airport property. 2D9062A was later found not liable for violating the ordinance due to the City's failure to establish a prima facie case. The complaint alleges a variety of civil rights and constitutional violations. Plaintiff seeks to proceed in forma pauperis. She states in her financial affidavit that she is unemployed, the date of her last employment was over four years ago, she has no assets, and her sole source of income is $623.00 per month in social security benefits. On these facts, 2D9062A has demonstrated her inability to pay court costs. In addition, we have reviewed the complaint, and it does not appear to satisfy any of the criteria for dismissal that are enumerated in 28 U.S.C. Section 1915(e)(2)(B). Accordingly, plaintiff's application for leave to proceed in forma pauperis is granted. The proper defendant in this case is the City of Chicago, not the Chicago Police Department. See Cleaves v. City of Chicago, 21 F. Supp. 2d 858 (N.D. Ill. 1998). Accordingly, the City of Chicago is substituted as defendant. Party City Of Chicago added. Chicago Police Dept. terminated.
