- ilnd;;1:06-cv-04873_de13 RegisterActionDescriptionText "MINUTE entry before Judge Blanche M. Manning : The draft judgment order submitted by the plaintiffs in connection with their motion for a default judgment does not comply with Federal Rule of Civil Procedure 65(d), which requires it to be specific in its terms and to describe in reasonable detail without reference to the complaint or another document the act or acts sought to be restrained. See Blue Cross and Blue Shield Association v. American Express Co., No. 05-4004, 2006 WL 3055950 (7th Cir. Oct. 30, 2006). In addition, the draft order does not include language regarding costs and fees. Finally, the language in the current draft order regarding retention of jurisdiction appears to be not only unnecessary (because the court necessarily retains jurisdiction to enforce orders granting injunctive relief), but also at odds with the Blue Cross decision. Accordingly, the plaintiffs are directed to submit, by December 21, 2006, an additional draft order, which complies with Rule 65 and is consistent with the Seventh Circuit's directives in Blue Cross. Mailed notice (rth, ) (Entered: 12/07/2006)" @default.
