- ilnd;;1:07-cv-04659_de6 RegisterActionDescriptionText "MINUTE entry before Judge Frederick J. Kapala : Plaintiff filed this action premised on the Court's diversity of citizenship jurisdiction. 28 U.S.C. section 1332(a)(1). Plaintiff fails to properly allege subject matter jurisdiction. Plaintiff has alleged that defendants Bradley Heinrich, Barbara Kammerer, Gezim Rushiti, Bryan Suh, Chun Park, and Chuong Nguyen are residents of the State of Illinois. However, citizenship is what matters for diversity jurisdiction purposes, Meyerson v. Harrah's East Chicago Casino, 229 F.3d 616, 617 (7th Cir. 2002). With regard to the defendants alleged to be Illinois limited liability companies (LLC's), such entities do not have citizenship for diversity purposes, Hicklin, L.C. v. Bartell, 439 F.3d 346, 347 (7th Cir. 2006); Cosgrove v. Bartolotta, 150 F.3d 729, 731 (7th Cir. 1998). The citizenship of all the members of an LLC is the relevant citizenship for diversity jurisdiction. Cosgrove, 150 F.3d at 731. Plaintiffs have alleged that defendants Park and Nguyen were the members of the LLC's, but do not allege their citizenship. Plaintiff shall file amended allegations of subject matter jurisdiction by 10/4/07 or this case will be dismissed for lack of proper subject matter jurisdiction. Electronic notices.
