Mr. Buckley is a "career offender," however, meaning that his base offense level was 34, pursuant to U.S.S.G. § 4F1.1 (b)(B). With adjustments, Mr. Buckley faced a guideline sentence of 188 to 235 months, and the court granted the government's motion for a 60% departure pursuant to U.S.S.G. § 5K1.1, resulting in a sentence of 112 months. Mr. Buckley now moves for a reduction in his sentence pursuant to Amendment 750, which had the effect of lowering the sentencing guidelines triggered by particular quantities of crack cocaine. In its objection to this motion, the government argues that Mr. Buckley is not eligible for a sentence reduction because the guideline range applicable to him rested not on the crack cocaine provisions, but on his status as a career offender. Though given ample opportunity to respond to this argument, Mr. Buckley has not done so.
