As discussed in opencourt, counsel shall immediately begin in-person meet and confer sessions regarding Plaintiff's production ofESI with a spirit of cooperation, transparency, and efficiency. Plaintiff shall take the lead in selecting datacustodians, search terms, and date ranges for Plaintiff's ESI. In advance of Plaintiff conducting its searches,Plaintiff shall disclose proposed data custodians, search terms, and date ranges to Defendant. Defendant shallthen provide input regarding Plaintiff's proposed data custodians, search terms, and date ranges in advance ofPlaintiff's searches. As part of the parties' dialogue, Defendant shall disclose to Plaintiff the data custodians,search terms, and date ranges it used to identify and produce responsive documents that could be identifiedwith reasonable diligence. Any issues or concerns regarding possible "Stage 2" search terms and productionsare deferred pending completion of Plaintiff's production of responsive documents, including ESI, that can beidentified with reasonable diligence. Counsel are expected to genuinely confer in good faith and makereasonable efforts to resolve discovery issues without court intervention. In the event the parties wish to file anyfuture discovery motions, they must follow the new procedures set forth below. Finally, prior to the next statushearing, Plaintiff's counsel shall contact and work with Adaptive Microware to identify which specific documentsor categories of documents can be de-designated.
